    Reporting to the General Counsel & VP of Compliance, the Compliance Manager will oversee the development, implementation, and operation of a comprehensive and effective compliance program and provide guidance on regulatory changes and activity that may impact the company’s products and services. The Compliance Manager will strive to continuously improve Ingenious Med’s compliance program and enhance the company’s strong culture of compliance in pursuit of the following objectives:

    • Promoting an ethical culture and a commitment to comply with all applicable laws
    • Establishing, managing, and monitoring mechanisms and infrastructure that prevent and detect wrongdoing
    • Implementing a framework to identify, prioritize, and enable the effective and efficient management of compliance risks
    • Ensuring our products’ compliance with all applicable laws and regulations

    This position does not have any direct reports and does not require travel.

     

    Responsibilities

    • Prepare formal written annual compliance plans. 
    • Consistently attend, and take and maintain minutes of, the company’s compliance committee meetings. Provide guidance and recommendations regarding the company’s compliance to the compliance committee.
    • Develop, implement, and periodically review compliance-related policies and procedures to prevent illegal, unethical, or improper conduct and to ensure compliance with all regulations, including HIPAA.
    • Develop, implement, and periodically review our Code of Conduct to ensure continuing currency and relevance in providing guidance to our workforce and vendors.
    • Develop, implement, and maintain conflict of interest process for workforce members, vendors, and business partners.
    • Work with Human Resources to develop and present appropriate introductory compliance training for new employees, as well as ongoing training of our workforce on our Code of Conduct, our corporate compliance program, HIPAA, and other compliance issues as necessary.
    • Maintain and promote awareness of company-wide reporting channels, including the company's compliance hotline, to encourage reporting of problems or concerns without fear of retaliation. 
    • Conduct or assist in conducting investigations and preparing responses to complaints of alleged violations of standards of conduct and compliance-related regulations, policies, and procedures.
    • Develop and oversee a system for uniform handling of compliance-related violations.
    • Regularly conduct internal audits and monitoring activities to prevent and detect compliance-related issues, and communicate findings to the company’s compliance committee.
    • Serve as primary point of contact for external audits, and prepare formal responses to such audits’ findings/recommendations.
    • Conduct annual risk assessments to identify potential areas of compliance vulnerability and risk. 
    • Recommend, and monitor the implementation of, corrective actions to address any non-conforming practices or other compliance issues identified via audits, monitoring, and risk assessments.
    • Regularly benchmark, assess, and measure the compliance program’s effectiveness in reducing the likelihood of violations of the law and in encouraging and supporting ethical business behavior.
    • Provide periodic and ad hoc reports to keep senior management informed of the operation and progress of compliance efforts.
    • Collaborate with the company’s IT department to ensure that the company’s health information data and operations comply with privacy and security requirements, and assist as needed with HITRUST and similar certification processes.
    • Monitor regulatory changes and evaluate their impacts on Ingenious Med’s products and services. Provide strategic input to ensure continued compliance with applicable regulations and client regulatory obligations.
    • Assist as needed with the negotiation of compliance and privacy related issues in contracts, business associate agreements, and other agreements with clients, vendors, and business partners.
    • Function as a subject matter expert and internal consultant on special projects or initiatives.

    Qualifications

    ·         Bachelor’s degree.

    ·         MBA, MHA, JD, or equivalent education preferred.

    ·         Certified in Healthcare Compliance (CHC), Certified in Healthcare Privacy Compliance (CHPC) and/or Certified in Compliance & Ethics Professional (CCEP) certifications preferred.

    ·         A minimum of 5-8 years of experience in compliance, preferably in healthcare or healthcare IT, with increasing levels of responsibility.

    ·         Knowledge of relevant laws and regulations applicable to the health care industry, including HIPAA and other privacy laws, Stark, False Claims Act, Anti-Kickback Statute, CMS/Medicare, and other federal and state  regulatory requirements and guidance applicable to the healthcare industry.

    ·         Understanding of healthcare coding and billing practices and regulations preferred.

    ·         Knowledge of business and operations of healthcare IT or software company preferred.

    ·         Experience with SOC 2 Type II and/or HITRUST certification processes preferred.

    ·         Demonstrated experience in developing, overseeing, and managing an effective healthcare compliance program.
